    Preamble

    These general terms and conditions of use hereinafter referred to as the "GTCU" are entered into on the one hand by the company Victor Manuel LOPEZ HERNANDEZ - TCC, EURL (VMLH-TCC, EURL) with a share capital of one hundred euros (€100), whose registered office is located at 10 Rue Antoine Chantin, 75014 Paris, registered with the R.C.S. of Paris with the number: 930 612 320, hereinafter referred to as "VMLH-TCC, EURL". The present General Conditions of Use govern the use of the Alésia Thérapie website (https://www.vmlh-tcc.fr) operated by the company VMLH-TCC EURL". By accessing and using this site, the user accepts these Terms of Use without reservation.

    Article 1. Purpose

    The purpose of the GCU is to define the conditions of use of the Alésia Thérapie website (https://www.vmlh-tcc.fr). Any access to and/or use of the site implies acceptance of and compliance with all the terms of these Terms and Conditions.

    Article 2. Access to the Site

    Access to the Site is free for any user with Internet access. All costs relating to access to the Site, whether hardware, software or Internet access costs, shall be borne exclusively by the user.

    Article 3. Services offered

    The site enables users to make appointments for cognitive behavioural therapy (CBT) consultations, coaching, workshops or training courses. The site also allows users to contact the therapist directly by telephone, by direct message, by e-mail and via the site's contact form. Detailed information on each type of consultation and other therapeutic services is available on the site.

    Article 4. Use of the Site

    The user undertakes to use the site in accordance with these GCU and the laws in force. In particular, he/she shall not

    Distributing content that is unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene or invasive of the privacy of others.

    Disrupt or attempt to disrupt the operation of the site or the services accessible from the site.

    Article 5. Intellectual property rights

    All elements of the site (texts, images, logos, videos, etc.) are protected by intellectual property laws.     Article 10. Applicable Law and Jurisdiction

    These GTUs are governed by French law. In the event of any dispute relating to the interpretation or performance of these GCU, the courts of Paris shall have jurisdiction.

  • General Terms and Conditions of Sale – Cognitive Behavioral Therapy (CBT) Consultations, Coaching, Training, and Workshops

    These General Terms and Conditions of Sale (hereinafter "T&Cs") are entered into by, on one hand, the company Victor Manuel LOPEZ HERNANDEZ - TCC, EURL (VMLH-TCC, EURL), with a share capital of one hundred euros (€100), headquartered at 10 Rue Antoine Chantin, 75014 Paris, registered with the Paris Trade and Companies Register under number: 930 612 320, hereinafter referred to as "VMLH-TCC, EURL" and managing the website VMLH-TCC, https://www.vmlh-tcc.fr, and, on the other hand, any individual wishing to book an appointment for a consultation via the VMLH-TCC website, https://www.vmlh-tcc.fr, hereinafter referred to as "the patient."

    Article 1. Purpose

    These terms aim to define the contractual relationship between VMLH-TCC, EURL and the patient, as well as the conditions applicable to any consultation for cognitive behavioral therapy (CBT), coaching, workshop, or training requested via the VMLH-TCC website, https://www.vmlh-tcc.fr. Booking an appointment through this site implies the patient's unreserved acceptance of these terms, which the patient acknowledges having read prior to booking. Before any transaction, the patient declares that the appointment for cognitive behavioral therapy via the VMLH-TCC website is unrelated to their professional activity and is limited to strictly personal use, and declares they have the legal capacity to commit to these General Terms and Conditions of Sale.

    VMLH-TCC, EURL reserves the right to modify these terms at any time, in order to comply with new regulations or improve the use of its site. As a result, the applicable conditions will be those in force on the date of the appointment booking by the patient.

    Article 2. Services

    The services offered are those listed on the VMLH-TCC website, https://www.vmlh-tcc.fr, within the limits of available time slots. VMLH-TCC, EURL reserves the right to modify or adapt the consultations offered at any time in line with developments in the field of mental health. Each type of consultation is presented on the website with a description of its main terms. Photographs are as accurate as possible but are not binding on the company.

    Article 3. Pricing

    The prices listed on the consultation descriptions on the website are in Euros (€), including all taxes (VAT included) based on the applicable VAT rate on the day of the consultation. Any change in the VAT rate may be reflected in the consultation prices. VMLH-TCC, EURL reserves the right to change its prices at any time, with the understanding that the price listed on the website on the day of booking will be the only price applicable to the patient. Prices do not include any additional telephone consultations outside the scheduled appointment time, which will be billed separately at the consultation rate. The prices for workshops and training sessions are established based on a quote and depending on whether they are individual or group sessions.

    Article 4. Consultations, Teleconsultations, and Payment Methods

    Consultations: Cognitive behavioral therapy sessions take place at the office located at 10 Rue Antoine Chantin, 75014 Paris. However, as some CBT sessions may involve real-world exposure, certain sessions may take place outdoors according to the strategies established with the patient.

    Payment Methods: VMLH-TCC, EURL offers two payment options:

    • Credit card payment after the consultation (Visa, Mastercard, Amex, all contactless cards)

    • Cash payment after the consultation

    Teleconsultations: This method allows therapy to be conducted remotely. It is possible to conduct psychotherapy via video conferencing. Sessions occur at regular intervals just as they would in-person. A patient may convert an in-office appointment to a teleconsultation or vice versa by giving at least 48 hours’ notice, except in the case of compelling reasons where the consultation may be rescheduled or transformed.

    Remote consultation rates are the same as those for in-office sessions. To confirm the appointment, the session must be prepaid. If an unforeseen event prevents the session, it will simply be rescheduled.

    How does a remote session work? Once payment is made via the secure payment link, the slot is reserved, and the therapist contacts you at the scheduled session time.

    For video consultations, the patient must ensure they have access to a computer with a good internet connection. The Zoom, Teams, or Google Meet connection link will be sent via email before the appointment to ensure timely access. A quiet place where privacy can be maintained is essential for the proper conduct of the consultation.

    Workshops and group training take place in rented facilities arranged by the company. Patients will receive details regarding the location by email. The company commits to renting facilities within approximately 5 km of the office at 10 Rue Antoine Chantin, 75014 Paris.

    Booking a consultation (appointment) or a training/workshop session constitutes acceptance of these terms, acknowledgment of full knowledge of them, and waiver of the right to invoke one’s own purchase terms. All data provided and the recorded confirmation will serve as proof of the transaction. If the patient provides an email address and phone number, VMLH-TCC, EURL will confirm the booking by email or phone.

    Article 5. Consultation Reimbursement

    Psychotherapy sessions are not reimbursed by Social Security. However, some health insurance providers offer partial reimbursement upon presentation of an invoice. To determine if cognitive behavioral therapy is covered, please contact your insurance company.

    Article 6. Withdrawal

    In accordance with Article L121-20 of the Consumer Code, the patient has a period of fourteen business days from the appointment booking date to exercise their right of withdrawal and cancel the appointment without penalty, provided they comply with the cancellation conditions described in Article 7 of these terms.

    Article 7. Delays and Cancellations

    In the event of a delay by the patient, the session will not be extended and the delay will be deducted from the session time. Sessions canceled less than 48 hours in advance (except in cases of compelling reasons) will be considered due. Conversion to a teleconsultation may be offered if the patient is unable to attend an in-office session, in which case the session must be prepaid as described in Article 4 - Teleconsultations.

    Article 8. Liability

    VMLH-TCC, EURL is only bound by a best-efforts obligation during teleconsultations and shall not be liable for damages resulting from the use of the internet, such as data loss, intrusion, viruses, service interruption, or other unintended problems. The patient is responsible for ensuring the confidentiality of their consultation as outlined in Article 4 - Teleconsultations.

    Article 9. Intellectual Property

    All elements of the VMLH-TCC website, https://www.vmlh-tcc.fr, are and remain the intellectual and exclusive property of VMLH-TCC, EURL. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site, including photos, logos, visuals, or text. This intellectual property extends to any future publications made by the company or on its behalf.

    Article 10. Personal Data

    VMLH-TCC, EURL commits to maintaining the confidentiality of information provided by the patient, whether transmitted via the contact form, email, or phone for booking an appointment. All data is subject to GDPR.     Article 11. Dispute Resolution

    These remote sales terms are subject to French law. For any disputes or litigation, the competent court shall be the one located in Paris.

  • Introduction

    Maintaining professional confidentiality is a fundamental obligation for psychotherapy practitioners, psychologists, and all mental health professionals in accordance with the legal and regulatory provisions in force in France, particularly Articles 226-13 and 226-14 of the Penal Code, as well as the provisions of the Public Health Code. This charter aims to guarantee the confidentiality of information shared by patients and to establish a clear framework for respecting professional ethics.

    Article 1: Definitions

    • Professional Confidentiality: The obligation for mental health professionals not to disclose confidential information received during their practice, as per Articles 226-13 and 226-14 of the Penal Code.

    • Patient: Any person receiving therapeutic services from a VMLH-TCC professional.

    Article 2: General Principles

    1. Absolute Confidentiality: VMLH-TCC EURL practitioners commit to maintaining the strictest confidentiality concerning patient information, except where legal exceptions apply.

    2. Respect and Dignity: Every patient must be treated with respect and dignity, ensuring the confidentiality of all exchanges.

    Article 3: Commitments of Psychotherapy Practitioners

    1. Non-Disclosure: Psychotherapy practitioners commit never to disclose confidential information obtained in the course of their profession, except in cases provided by law (Article 226-14 of the Penal Code).

    2. Data Protection: Practitioners must ensure that patient information and records are securely stored, in compliance with the General Data Protection Regulation (GDPR).

    3. Informed Consent: Practitioners must inform patients of their rights regarding confidentiality and obtain their informed consent for any necessary disclosure, in accordance with Articles L1111-2 and L1111-4 of the Public Health Code.

    Article 4: Exceptions to Confidentiality

    Psychotherapy practitioners may be required to breach professional confidentiality in the following cases, in accordance with Article 226-14 of the Penal Code:

    1. Imminent Danger: If the patient or another person is in immediate danger, the practitioner may disclose the necessary information to prevent that danger.

    2. Legal Obligations: If the law requires the disclosure of certain information, practitioners must comply with legal obligations, particularly in cases of abuse or neglect involving a minor under 15 years of age or a person unable to protect themselves due to age, physical, or mental condition.

    Article 5: Sanctions

    Failure to comply with the commitments outlined in this charter may result in professional sanctions, including internal disciplinary measures and, if necessary, legal actions in accordance with the Code of Ethics for Psychologists and penalties provided by law.

    Article 6: Acceptance of the Charter

    By accepting this charter, VMLH-TCC EURL psychotherapy practitioners acknowledge having read their obligations and commit to adhering to the terms and conditions stated.
